Not Another Monday is developed by Chooky Chasing Life.
These Terms of Use (“Terms”) govern your access to and use of the Not Another Monday mobile application (the “App”), operated by Chooky Chasing Life, ABN 38 238 167 325 (“we”, “us” or “our”). By downloading, accessing or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1The service
Not Another Monday is a personal habit, fasting, journaling and wellness-tracking application. The App is intended for general wellness and personal organisation purposes only.
The App is not a medical device and does not provide medical advice, diagnosis or treatment. Consult a qualified healthcare provider before making changes to your diet, fasting routine or exercise habits, particularly if you have any pre-existing health condition.
2Accounts
You must create an account (via Sign in with Apple or Google Sign-In) to use the App. You are responsible for maintaining the security of your account and for all activity under it.
You may permanently delete your account and all associated data at any time from within the App’s Profile settings. See Delete your account.
3Subscriptions
Certain features of the App (“Not Another Monday Premium”) are available only through an auto-renewing subscription, offered on a monthly or annual basis.
- Payment: payment will be charged to your Apple ID or Google Play account at confirmation of purchase.
- Auto-renewal: subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
- Free trial: new subscribers may be offered a free trial period. If you do not cancel before the trial ends, you will be automatically charged for the subscription.
- Managing and cancelling: you can manage or cancel your subscription at any time through your Apple ID account settings (App Store) or Google Play account settings, or via the “Manage Subscription” option within the App.
- Refunds: refund requests are handled by Apple or Google in accordance with their own respective policies, not by us directly.
4Acceptable use
You agree not to:
- use the App for any unlawful purpose;
- attempt to reverse-engineer, decompile or interfere with the App;
- use the App to harass or harm another user, including an accountability partner; or
- misrepresent your identity when connecting with an accountability partner.
5User content
You retain ownership of any content you create in the App (journal entries, progress photos, profile information). You grant us a limited licence to store and process this content solely to provide and maintain the App’s functionality.
We do not share your private content (journal entries, photos, weight) with any other user, including accountability partners.
6Termination
We may suspend or terminate your access to the App if you violate these Terms. You may stop using the App and delete your account at any time.
7Disclaimer of warranties
The App is provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that the App will be uninterrupted or error-free, or that any health, fitness or wellness outcome will result from use of the App.
8Limitation of liability
To the maximum extent permitted by law, Chooky Chasing Life shall not be liable for any indirect, incidental, special or consequential damages arising from your use of the App.
9Changes to these terms
We may update these Terms from time to time. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.
10Governing law
These Terms are governed by the laws of Queensland, Australia, without regard to conflict-of-law principles.
